NOTICE OF PUBLIC HEARING

AND

BUSINESS IMPACT ESTIMATE

 

The City of Plant City, Florida proposes to adopt the following ordinance:

AN ORDINANCE OF THE CITY OF PLANT CITY, FLORIDA ADOPTING AN AMENDMENT TO THE COMPREHENSIVE PLAN AND THE COMPREHENSIVE PLAN FUTURE LAND USE MAP, AS PROVIDED BY LAW, FOR APPROXIMATELY 40.02 ACRES OF REAL PROPERTY LOCATED EAST OF SOUTH BAPTIST CHURCH ROAD, SOUTH OF ALEXANDER STREET, NORTH OF CHARLIE GRIFFIN ROAD, AND WEST OF JAMES L REDMAN PARKWAY FROM HILLSBOROUGH COUNTY RESIDENTIAL-1 (RES-1), PLANT CITY COMMERCIAL, AND PLANT CITY RESIDENTIAL-20 (RES-20) TO PLANT CITY RESIDENTIAL-9 (RES-9); PROVIDING TRANSMISSION TO THE APPROPRIATE AGENCIES; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE (PC/CPA 23-01).

Notice is hereby given that the City Commission of the City of Plant City intends to consider an amendment to the Comprehensive Plan for the City of Plant City at a public hearing to be held:

Date: Monday, May 13, 2024
Time: 7:30 P.M.
(or as soon thereafter as the matter may be heard)
Place: City Commission Chambers of the Nettie Berry

               Draughon Municipal Building (City Hall) at 302 West Reynolds

               Street, Plant City, Florida 33563.

 

At the conclusion of the public hearing, the City Commission will consider an ordinance to adopt the amendment. Final action of the City Commission may provide alternative language and proposals. Any person who might wish to appeal any decision made by the City Commission regarding any matter considered at the forthcoming public hearing is advised that they will need a record of proceedings, and for such purpose, they may need to ensure that a verbatim record of the proceedings is made, which will include the testimony and evidence upon which such appeal is to be based. Interested parties wishing to utilize an electronic presentation (i.e. PowerPoint) at these proceedings must provide the City Clerk a computer file of such at least two business days prior to the aforementioned public hearing date. In accordance with the Americans with Disabilities Act, any person with a disability requiring reasonable accommodation in order to participate in this hearing should call the City Clerk at (813) 659-4200, at least 48 hours prior to the public hearing.

The public is invited to attend the public hearing. At the public hearing, the applicant (including their agents and representatives), the City (including staff and consultants), the Hillsborough County City-County Planning Commission (including staff and consultants), and other governmental agencies (including staff and consultants) shall each be allowed five (5) minutes to speak, unless additional time is requested to the City Clerk no less than 48 hours prior to the public hearing. All other speakers shall be limited to three (3) minutes. In the event speaker(s) request additional time the determination of the amount of time to be allowed shall be at the discretion of the Mayor. This Business Impact Estimate is provided in accordance with section 166.041(4), Florida Statutes.  If one or more boxes are checked below, this means the City of Plant City (the "City") is of the view that a business impact estimate is not required by state law1 for the proposed ordinance, but the City is, nevertheless providing this Business Impact Estimate as a courtesy and to avoid any procedural issues that could impact the enactment of the proposed ordinance.  This Business Impact Estimate may be revised following its initial posting.

☐       The proposed ordinance is required for compliance with Federal or State law or regulation;

☐       The proposed ordinance relates to the issuance or refinancing of debt;

☐       The proposed ordinance relates to the adoption of budgets or budget amendments, including revenue sources necessary to fund the budget;

☐       The proposed ordinance is required to implement a contract or an agreement, including, but not limited to, any Federal, State, local, or private grant, or other financial assistance accepted by the municipal government.

         The proposed ordinance is enacted to implement the following:

  a. Part II of Chapter 163, Florida Statutes, relating to growth policy, county and municipal

  b. Sections 190.005 and 190.046, Florida Statutes, regarding community development districts;

  c. Section 553.73, Florida Statutes, relating to the Florida Building Code; or

  d.   Section 633.202, Florida Statutes, relating to the Florida Fire Prevention Code

In accordance with the provisions of controlling law, even notwithstanding the fact that, an exemption noted above may apply, the City hereby publishes the following information:

1. Summary of the proposed ordinance (must include statement of the public purpose, such as serving the public health, safety, morals, and welfare):

Ordinance 22-2024 would change the future land use on a parcel from Hillsborough County Residential-1 (RES-1), Plant City Commercial and Plant City Residential-20 to Plant City Residential-9. Serves public purpose to impose a land use designation on the parcel to determine the allowable use of the property.

2. An estimate of the direct economic impact of the proposed ordinance on private, for-profit businesses in the City, if any:

(a) An estimate of direct compliance costs that businesses may reasonably incur;

(b) Any new charge or fee imposed by the proposed ordinance, or for which businesses will be financially responsible; and

(c) An estimate of the City’s regulatory costs, including estimated revenues from any new charges or fees to cover such costs.

 

The proposed ordinance is an amendment to the Comprehensive Plan and amends the land use map of the City to allow for residential uses on the property. There are currently no businesses located on the property. The adoption of Ordinance 22-2024 does not impose any direct compliance costs on any businesses, nor does the ordinance impose any new charge or fee for which businesses will be financially responsible. The ordinance imposes no regulatory costs.
 
3. Good faith estimate of the number of businesses likely to be impacted by the proposed ordinance:

There are currently no businesses located on the property. The proposed project will be for residential uses.

4. Additional information the governing body deems useful (if any):

The property was recently annexed and currently has a county land use designation.  Pursuant to Section 171.062, Florida Statutes, when the City amends the land use designation on the property, the property is subject to the City’s zoning and subdivision regulations.
